  1. APPLICABLE LAW AND JURISDICTION

These conditions are governed by the current Spanish regulations applicable to them. For the resolution of disputes that may arise as a consequence of the provisions of these terms, and expressly waiving any other jurisdiction that may correspond, the User agrees to submit to the Jurisdiction of the Courts and Tribunals of BARBATE, except in relation to matters arising from the online sales contract itself, which shall be subject to the jurisdiction of the buyer’s domicile.

In accordance with Article 2 of REGULATION (EU) 2024/3228 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 19 December 2024 repealing Regulation (EU) No 524/2013 and amending Regulations (EU) 2017/2394 and (EU) 2018/1724 as regards the suppression of the European online dispute resolution platform, the European online dispute resolution platform (hereinafter ‘ODR platform’) is suppressed and consequently no further complaints may be submitted to the ODR platform from 20 March 2025.

  1. SEVERABILITY AND INVALIDITY OF CLAUSES

If any clause included in these Terms is declared totally or partially null, void, or unenforceable, such nullity or unenforceability shall affect only that provision or the part thereof that is null, void, or unenforceable, with the Terms remaining in full force and effect in all other respects.
